Medicare Eligibility Analysis

Medicare Eligibility Analysis and Medical Records Review Services

Physicians Medical Review is a physician-owned and -operated medical consulting firm providing plaintiff attorneys, defense attorneys, insurance company professionals, and others taking part in workers’ compensation cases involving Medicare, with thorough medical records review services. One of the first steps in determining a Medicare set-aside allocation is the injured party’s Medicare eligibility. If a person is found to be eligible for Medicare, or is expected to become eligible within 30 months of the settlement date and the total settlement can be expected to exceed $250,000, a Medicare set-aside report compiled by PMR will clearly establish the costs the Medicare system must bear as the secondary payer.

If you are involved in medical litigation and would benefit from Medicare eligibility analysis and medical records review services, please contact Physicians Medical Review.

Who Is Eligible for Medicare?

Those who are eligible for Medicare typically have worked in Medicare-covered employment for at least 10 years and are older than age 65. Medicare recipients must also be U.S. citizens or permanent U.S. residents. There are instances when a person younger than 65 who is disabled could be eligible for Medicare. Physicians Medical Review can quickly and effectively determine if a person is eligible for Medicare and in need of a Medicare set-aside allocation in order to settle a workers’ compensation case.

Why Is It Important to Determine Medicare Eligibility?

If the claimant in your case is determined to be a Medicare beneficiary, federal guidelines stipulate that Medicare’s interests must be taken into account before settling a workers’ compensation claim. In injury-related medical expenses of the type typically covered by Medicare, those with Medicare eligibility must set aside settlement dollars in order to prevent the shifting of the burden of payment from the primary payer to Medicare. These requirements are met through medical records review services and the development of Medicare set-aside allocations by PMR.
